1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the Name to Avatar website, Dashboard, API, generators, and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Name to Avatar provides tools for creating and managing synthetic names, avatars, identities, company rosters, and related data. Features, limits, models, prices, and availability may change as the Service evolves.
3. Eligibility and accounts
You must be at least 16 years old and legally able to enter into these Terms. You are responsible for activity under your account and for keeping access to your sign-in provider secure. Information you provide must be accurate and current.
4. API keys and integrations
API keys and other credentials are confidential and must not be shared publicly. You are responsible for requests made with your credentials. You must promptly revoke a credential if you believe it has been exposed or misused.
5. Credits and payments
Some features consume credits. Prices, credit amounts, and applicable charges are shown before purchase or described in the Service. Credits have no cash value, are not transferable, and may be used only with the Service.
Payments are handled by a third-party payment provider and may be subject to its terms. Except where required by law, completed purchases are non-refundable. Contact customer support if you believe a charge was made in error.
6. Your inputs and generated content
You retain any rights you have in content you submit. You grant us a limited license to process, store, reproduce, and transmit that content as needed to operate and improve the Service.
Generated content may resemble real people, names, organizations, or other material by coincidence. You are responsible for reviewing outputs and ensuring that your use of them complies with law and does not infringe, impersonate, mislead, defame, or harm others. We do not guarantee that generated content is unique, accurate, or suitable for a particular purpose.
7. Public resources
Resources created or shared with public visibility may be viewed, linked to, or reused through public features and APIs. Do not submit personal, confidential, or sensitive information for public generation. You are responsible for choosing appropriate visibility settings.
8. Acceptable use
You must not:
- Use the Service for unlawful, fraudulent, abusive, harassing, or deceptive activity.
- Create or distribute content that violates privacy, publicity, intellectual property, or other rights.
- Attempt to bypass rate limits, billing, access controls, or security measures.
- Probe, disrupt, overload, scrape, or reverse engineer the Service except where applicable law expressly permits it.
- Resell access to the Service or credentials without written permission.
- Use generated identities to impersonate real people or facilitate spam, fraud, surveillance, or identity theft.
9. Our intellectual property
The Service, including its software, design, branding, documentation, and original site content, is owned by us or our licensors. These Terms do not grant you ownership of the Service or permission to use our trademarks.
10. Third-party services
The Service depends on third-party providers and may link to third-party sites. We are not responsible for third-party services, content, availability, or policies. Your use of them may be governed by separate terms.
11. Suspension and termination
You may stop using the Service at any time. We may limit, suspend, or terminate access if you violate these Terms, create risk for the Service or others, fail to pay applicable charges, or if continuing to provide the Service is no longer practical.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not warrant uninterrupted operation, error-free results, or the accuracy, uniqueness, legality, or fitness of generated content.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunities arising from the Service. Our total liability for claims relating to the Service will not exceed the amount you paid us during the 12 months before the event giving rise to the claim.
14. Changes to the Service or Terms
We may modify or discontinue all or part of the Service. We may also update these Terms. We will revise the date above when they change, and continued use after an update constitutes acceptance of the revised Terms.
15. Governing law and contact
